General Terms and Conditions (GTC)
RIPA Plastics is a registered brand owned and operated by D&G Recycling GmbH.
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts, deliveries, and services between D&G Recycling GmbH (hereinafter referred to as “D&G”) and its customers in the version valid at the time of contract conclusion. Deviating terms and conditions of the customer shall not apply unless D&G has expressly agreed to their validity in writing.
2. Services
D&G provides services in the fields of recycling, waste disposal, transport, and trading of valuable and secondary raw materials. The exact scope of services results from the individual contract or offer.
3. Conclusion of Contract
A contract is concluded through written or verbal agreement, but at the latest upon acceptance of the service by the customer. Offers made by D&G are non-binding and subject to change.
4. Prices and Payment Terms
All prices are quoted in euros and are subject to statutory VAT, unless otherwise stated. Payment is due immediately upon invoicing without any deduction, unless another payment term has been agreed. In the event of late payment, D&G reserves the right to charge statutory default interest.
5. Retention of Title
Until full payment of all claims arising from the contract has been made, the delivered goods or recycling materials remain the property of D&G.
6. Customer Obligations
The customer undertakes to provide only suitable, permissible, and properly declared materials for collection or acceptance. In the event of violations of legal regulations or incorrect declarations, D&G reserves the right to claim damages.
7. Liability
D&G shall only be liable for damages caused by intentional or grossly negligent conduct. In cases of simple negligence, D&G shall only be liable for breaches of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage. Liability for indirect damages and loss of profit is excluded.
8. Warranty
The statutory warranty rights apply unless otherwise agreed. Complaints must be submitted in writing without delay after becoming known.
9. Data Protection
D&G processes personal data exclusively in accordance with applicable data protection laws. Further details can be found in the privacy policy on our website.
10. Place of Jurisdiction and Applicable Law
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from the contractual relationship shall be Nördlingen, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
11. Severability Clause
Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the one that comes closest to the economic purpose of the invalid clause shall apply.
